Welcome to Pawprints

These Terms of Service ("Terms") govern your access to and use of the Pawprints.Love website, mobile applications, and services (collectively, the "Service"). The Service is operated by Alta Ventures LLC ("Pawprints," "we," "our," or "us").

By accessing or using Pawprints, you agree to be bound by these Terms. If you don't agree, please don't use our Service.

Please read these Terms carefully. They contain important information about your rights and obligations, including limitations on our liability and how disputes are resolved.

1. Who Can Use Pawprints

Age Requirements

You must be at least 13 years old to use Pawprints. If you are between 13 and 18 years old, you must have permission from a parent or legal guardian who agrees to these Terms on your behalf.

Account Eligibility

To create an account, you must:

  • Be a human (no bots or automated accounts)
  • Provide accurate and complete registration information
  • Not have been previously banned from Pawprints
  • Not be legally prohibited from using our Service

One Person, Multiple Pets

You may create profiles for multiple pets under a single account, subject to the limits of your subscription tier.

2. Your Account

Account Creation

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Keep your information updated
  • Maintain the security of your password
  • Accept responsibility for all activity under your account
  • Notify us immediately if you suspect unauthorized access

Account Security

You are responsible for safeguarding your password and any other credentials used to access your account. We cannot and will not be liable for any loss or damage arising from your failure to maintain the security of your account.

One Account Per Person

Each person should maintain only one account. Creating multiple accounts to circumvent restrictions, abuse free trials, or for any deceptive purpose is prohibited.

3. Your Content

What Is "Your Content"

"Your Content" means any photos, videos, text, graphics, letters, profile information, or other materials you upload, post, or display on Pawprints.

You Own Your Content

You retain full ownership and all intellectual property rights to Your Content. We do not claim ownership of anything you create or upload.

License You Grant Us

To provide the Service, you grant Pawprints a license to use Your Content as follows:

For All Content:
  • A worldwide, non-exclusive, royalty-free license to host, store, cache, backup, and transmit Your Content solely for the purpose of operating and providing the Service
For Private Content:
  • We will only display private content to you and users you explicitly authorize
  • We will not use private content for marketing, promotion, or any purpose other than providing the Service to you
For Public Content:
  • In addition to the above, a license to reproduce, display, distribute, and create derivative works (such as thumbnails or previews) of Your Content in connection with operating, promoting, and improving the Service
  • This includes the right to feature Your Content on our website, social media, or marketing materials
  • We will always attribute public content to your profile when featured

Your Representations

By uploading content, you represent and warrant that:

  • You own the content or have the right to use and share it
  • Your content does not infringe any third party's intellectual property rights
  • Your content does not violate any law or these Terms
  • You have obtained necessary consents from any identifiable individuals (human) in your content

Content Removal

  • You may delete Your Content at any time through your account settings
  • Deleted content will be removed from public view immediately
  • Backup copies may persist for up to 90 days
  • We may retain certain content if required by law

4. Acceptable Use

You Agree NOT To:

Harmful Content
  • Upload content depicting animal abuse, cruelty, or neglect
  • Post content that is illegal, defamatory, or fraudulent
  • Share content that is sexually explicit, pornographic, or obscene
  • Upload content that promotes violence, terrorism, or hate against any group
Harassment and Abuse
  • Harass, bully, intimidate, or threaten other users
  • Post tributes or comments intended to cause distress to grieving users
  • Impersonate another person or misrepresent your identity
  • Stalk or repeatedly contact users who have asked you to stop
Spam and Deception
  • Use Pawprints for advertising or commercial solicitation without permission
  • Send spam, chain letters, or unsolicited promotional content
  • Create fake pet profiles or memorial pages for non-existent pets
  • Manipulate engagement metrics through fake accounts or automated tools
Security and Integrity
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Introduce viruses, malware, or other harmful code
  • Scrape, crawl, or use automated tools to collect data from Pawprints
  • Interfere with or disrupt the Service or servers
  • Circumvent any access controls or usage limits
Intellectual Property
  • Infringe the copyright, trademark, or other rights of third parties
  • Remove or alter any copyright or proprietary notices

Consequences of Violations

Violations may result in:

  • Removal of offending content
  • Warning or temporary suspension
  • Permanent account termination
  • Legal action where appropriate

We reserve the right to investigate violations and take appropriate action in our sole discretion.

5. Subscriptions and Payments

Subscription Tiers

Pawprints offers multiple subscription tiers, including a free option and paid plans with additional features. Current pricing, features, and plan details are available on our Pricing Page.

Prices are in US dollars and may be subject to applicable taxes. Features and pricing are subject to change; any changes will be reflected on the Pricing Page.

Free Trial

New users may be eligible for a free trial of paid features. Trial terms will be disclosed at signup. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

Billing

  • Subscription fees are billed in advance
  • Monthly subscriptions are billed every 30 days
  • Annual subscriptions are billed every 365 days
  • You authorize us to charge your payment method on file for all applicable fees

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings.

Price Changes

We may change subscription prices from time to time. If we increase prices:

  • We will provide at least 30 days advance notice
  • The new price will take effect at your next renewal
  • You may cancel before the renewal to avoid the new price
  • Lifetime access holders are not affected by price increases

Payment Methods

We accept major credit cards and debit cards through our payment processor, Stripe. You agree to provide accurate and complete payment information and to keep it updated.

Failed Payments

If a payment fails:

  • We will attempt to charge your payment method again
  • We may send reminders to update your payment information
  • After multiple failures, your subscription may be downgraded to the free tier
  • You will not lose your content, but premium features will be disabled

Refunds

Monthly Subscriptions: No refunds for partial months. You retain access until the end of your current billing period.

Annual Subscriptions: You may request a refund within 14 days of your initial purchase or renewal if you have not substantially used the Service during that period. After 14 days, no refunds are provided.

Lifetime Access: You may request a full refund within 30 days of purchase if you have not substantially used the Service. After 30 days, no refunds are provided.

6. Free Tier and Feature Limitations

Free Tier

Pawprints offers a free tier with basic features for creating and sharing pet profiles. Free tier limitations and included features are detailed on our Pricing Page.

Feature Restrictions

Free accounts may have:

  • Limitations on storage, uploads, or number of profiles
  • Watermarks on shared content
  • Limited access to certain premium features
  • Lower priority for support requests

Specific limitations are detailed on the Pricing Page and may change from time to time.

Upgrading

You may upgrade to a paid subscription at any time. Your existing content will be preserved and premium features will be immediately available.

Downgrading

If you downgrade from a paid subscription to free:

  • Your content will be preserved but may exceed free tier limits
  • You will not be able to add new content until you are within limits
  • You will not lose existing content, but it may become read-only
  • You can delete content to return within limits or re-upgrade

7. Lifetime Access

What "Lifetime" Means

Pawprints may offer a "Lifetime" access option for certain subscription tiers. "Lifetime" access means access to the applicable tier's features for the lifetime of the Pawprints service, not the lifetime of any individual person or pet. This is a one-time purchase with no recurring fees.

Our Commitment

We intend to operate Pawprints indefinitely. However, if we ever discontinue the Service:

  • We will provide at least 90 days advance notice
  • We will provide a way to export your content
  • We will make reasonable efforts to transfer your data to a successor service if one exists
  • If the Service is discontinued within 3 years of your lifetime purchase, you will receive a prorated refund

What's Included

Lifetime access includes:

  • All features of the applicable tier at the time of purchase
  • Reasonable future feature updates to that tier
  • No additional fees for standard usage

Specific features included in lifetime access are detailed on our Pricing Page.

What's NOT Included

Lifetime access does not include:

  • Features requiring ongoing third-party costs (e.g., premium integrations)
  • Excessive storage or bandwidth beyond reasonable personal use
  • Features introduced as separate premium products or higher tiers

Transferability

Lifetime access is non-transferable and is tied to your account. It cannot be sold, gifted, or transferred to another person.

8. Memorial Profiles

Transition to Memorial Status

When a pet passes away, you can convert their profile to memorial status. Memorial profiles:

  • Display a special memorial design
  • Enable tribute/condolence features
  • Preserve the timeline and memories
  • Remain accessible indefinitely (subject to account status)

Memorial Profile Features

  • Tribute Wall: Friends and family can leave condolence messages
  • Candle Lighting: Virtual candles on anniversaries and special dates
  • Remembrance Dates: Mark anniversaries and significant dates
  • Privacy Controls: You control who can view and leave tributes

Tribute Moderation

  • All tributes require your approval before appearing publicly
  • You may delete any tribute at any time
  • We may remove tributes that violate our Community Guidelines
  • Repeat offenders may be banned from leaving tributes

Permanence of Memorials

We understand memorial profiles are sacred. Our commitment:

  • Memorial profiles are designed to remain accessible permanently
  • We will not delete memorial profiles due to account inactivity alone
  • If you delete your account, you will be asked whether to preserve or delete memorial profiles
  • Memorial profiles may be converted to read-only status for inactive accounts (see Inactive Accounts)

9. Legacy Contacts and Account Inheritance

Designating a Legacy Contact

Paid subscribers can designate a Legacy Contact - a trusted person who can manage your account if you become incapacitated or pass away. Check the Pricing Page for which tiers include this feature.

Your Legacy Contact can:

  • Access your account and content
  • Maintain memorial profiles for your pets
  • Download and export your content
  • Delete the account (if you've granted this permission)

Your Legacy Contact cannot:

  • Access private letters (unless you explicitly grant this permission)
  • Change your Legacy Contact designation
  • Access payment information

Setting Up a Legacy Contact

  1. Go to Account Settings > Legacy Contact
  2. Enter the email address of your trusted contact
  3. Choose the permissions you want to grant
  4. Your Legacy Contact will receive an email notification

If No Legacy Contact Is Designated

If you pass away without a designated Legacy Contact:

  • Immediate family members or estate executors may request access
  • Requests require proof of death and legal authority
  • We will review requests on a case-by-case basis
  • Processing may take 30-60 days

Requesting Access to a Deceased User's Account

Contact legacy@pawprints.love with:

  • Proof of death (death certificate)
  • Proof of your relationship or legal authority
  • Description of what access you're requesting

10. Community Guidelines

Pawprints is a community of pet lovers. To keep it safe and welcoming:

Be Kind

  • Treat other users with respect and empathy
  • Remember that many users are grieving
  • Offer support and compassion in tributes and comments

Be Authentic

  • Only create profiles for pets you own or are authorized to memorialize
  • Provide accurate information about your pets
  • Don't impersonate other users or create fake profiles

Be Appropriate

  • Keep content family-friendly
  • Don't share graphic, violent, or disturbing images
  • Respect others' privacy

Reporting Violations

If you see content that violates these guidelines, please report it using the report button on the content or by emailing support@pawprints.love.

We take reports seriously and will investigate promptly.

11. Intellectual Property

Our Intellectual Property

Pawprints, the Pawprints logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pawprints.Love LLC. You may not use these marks without our prior written permission.

The Service and its original content (excluding User Content), features, and functionality are owned by Pawprints and are protected by copyright, trademark, and other intellectual property laws.

Your Intellectual Property

As stated in Section 3, you retain ownership of Your Content. You grant us only the licenses necessary to provide the Service.

Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation or attribution.

14. Data Export and Portability

Your Right to Your Data

You have the right to request a copy of your content at any time.

How to Request an Export

Contact us at privacy@pawprints.love to request an export of your data. We will provide your content in a standard format (photos in original quality, text content as PDF or JSON) within 30 days of your request.

Export Upon Termination

If you delete your account or if we terminate your account, you may request an export of your data before deletion (except in cases of egregious Terms violations). We recommend requesting an export before initiating account deletion.

15. Service Availability and Modifications

Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we'll try to provide advance notice)
  • Unscheduled maintenance or repairs
  • Factors beyond our control (internet outages, natural disasters, etc.)

Modifications to the Service

We may modify, update, or discontinue features of the Service at any time. We will provide reasonable notice of material changes that negatively affect your use of the Service.

Service Discontinuation

If we decide to discontinue the Service entirely:

  • We will provide at least 90 days advance notice
  • We will provide tools to export your content
  • We will make reasonable efforts to help you preserve your memories

16. Account Suspension and Termination

Termination by You

You may delete your account at any time through your account settings. Upon deletion:

  • Your profile and content will be removed from public view
  • Data will be permanently deleted within 30-90 days
  • You will be asked whether to preserve or delete memorial profiles

Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms or our Community Guidelines
  • You engage in fraudulent or illegal activity
  • Your account is used for unauthorized commercial purposes
  • Required by law or legal process
  • We discontinue the Service

Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your content (except as required by law)
  • Provisions that should survive termination will survive (e.g., indemnification, limitation of liability)

Inactive Accounts

If your account has no login activity for 5 consecutive years:

  • We will attempt to contact you via email
  • If no response within 90 days, the account may be archived
  • Archived accounts preserve memorial profiles in read-only mode
  • You can reactivate by logging in and verifying your identity

17. Disclaimers

"As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or completeness of content

No Guarantee

WE DO NOT GUARANTEE THAT:

  • The Service will be uninterrupted, secure, or error-free
  • Results from the Service will be accurate or reliable
  • The Service will meet your requirements
  • Any errors will be corrected

Content Disclaimer

We do not endorse, verify, or guarantee the accuracy of user-generated content. You are responsible for evaluating the accuracy and completeness of any content.

Your Jurisdiction

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

18. Limitation of Liability

Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWPRINTS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from:
    • Your access to, use of, or inability to use the Service
    • Any conduct or content of any third party on the Service
    • Any content obtained from the Service
    • Unauthorized access to or alteration of your content

Cap on Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF:

  • The amount you paid us in the 12 months before the claim arose, OR
  • $100 USD

Essential Purpose

THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Your Jurisdiction

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so some of the above may not apply to you.

19. Indemnification

You agree to indemnify, defend, and hold harmless Pawprints and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your Content
  • Your violation of these Terms
  • Your violation of any third party's rights, including intellectual property rights
  • Your violation of any applicable law

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

20. Dispute Resolution and Arbitration

Informal Resolution First

Before filing any formal dispute, you agree to contact us at disputes@pawprints.love and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, you and Pawprints agree to resolve any claims through binding individual arbitration rather than in court, except:

  • You may bring claims in small claims court if eligible
  • Either party may seek injunctive relief in court for intellectual property violations

Arbitration Rules

Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules. The arbitration will be conducted:

  • In English
  • In the county where you reside or remotely via video conference
  • By a single arbitrator

Class Action Waiver

YOU AND PAWPRINTS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Opt-Out Right

You may opt out of arbitration by sending written notice to legal@pawprints.love within 30 days of first agreeing to these Terms. Your notice must include your name, address, email, and a clear statement that you wish to opt out.

21. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

For any disputes not subject to arbitration, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Contra Costa County, California.

22. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Pawprints regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your rights under them without our consent. We may assign our rights and obligations without restriction.

No Agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Pawprints.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of government, labor disputes, or infrastructure failures.

Headings

Section headings are for convenience only and do not affect interpretation.

Notices

We may provide notices to you via email, through the Service, or by posting on our website. You may contact us as described in the Contact Us section.

23. Changes to These Terms

We may revise these Terms from time to time. When we make changes:

For Minor Changes:
  • We will update the "Last Updated" date
  • Changes take effect upon posting
For Material Changes:
  • We will provide at least 30 days advance notice via email or prominent notice on the Service
  • Your continued use after the notice period constitutes acceptance

If you do not agree to the revised Terms, you must stop using the Service before they take effect.
